What does the Nevada Pardon Board consider important? 4 factors : Post Conviction Conduct Character and Reputation, Recency and Seriousness of the Offense, Atonement and Acceptance of Responsibility, and Need for Relief
So what are the most important things for a Pardon Applicant that are not listed in the official four factors?
# 1 - Ties to the community, marriage, children, stable work history
#2 - Charitable work, giving back to the community, worship.
#3 - Rehabilitation of any addictions
#4 - Continual self-improvement: promotions at work, professionalism and / or entrepreneurship. Leadership positions and /or positions of special trust and confidence in your work, leisure pursuits or faith.
How long does a Nevada Pardon Application Take? Approximately 1.5 years
How much will this Pardon Application cost me ?
Between $3500 and $6000 depending on the number of charges and total life experiences you have had - which increases the amount of time this process takes.
Here is how we can get your pardon together : A flowchart of processes.
# 1 - Hire the firm, make your payment - Fill out the Retainer Agreement, get the Pardon Waiver signed in front of a Notary, fill out the Pardon Application Intake form. Return all of these to me promptly.
# 2 - Schedule your Interview with me, set aside at least 3-4 hours, then conduct the interview, and be VERY HONEST with me - you need to tell me the whole truth and nothing but the truth. The good AND the bad, I know this may be painful for you, but your candor will be rewarded. What the Pardon Board and the INVESTIGATOR really want is TRANSPARENCY, honesty. Remember the fourth factor: Atonement and acceptance of responsibility. How can you completely accept responsibility unless you tell them everything? How can they forgive you unless they know everything you did? There is no more criminal liability here, you already received your punishment for your conviction - this is about seeking absolution.
# 3 - Start approaching people who know you well, who have seen you at your best, and when you were less than your best. Get them to write letters of recommendation for you. Obviously, you will want these letters to be from people who think VERY HIGHLY of you. The title of the person who writes the letter is not important. What is important is how well they know you, for how long, and the traits that they describe you as having - that match the four factors of the board. How you are a better person now, trustworthy, clean, hardworking, virtuous and living a legitimate lifestyle. That is what wins over and influences The Investigator and The Pardon Board, in my opinion.
# 4 - I complete your application and mail it in to the Nevada Pardon Board.
# 5 - Keep in touch with me - update your address and phone when necessary, so I can keep you updated as to progress.
# 6 - Send me your recommendation letters, so I can give them to the Pardon Board.
# 7 - The Nevada Division of Probation and Parole assigns you an investigator (probation officer) and asks you to fill out some forms. Respond promptly when the investigator mails you the forms to complete. I HIGHLY recommend that you treat this person as if they hold the keys to your pardon; i.e. be polite, respectful, courteous.
# 8 - Complete the forms for the investigator, I cannot do this for you, but your responses should mirror the ones you gave me.
# 9 - Receive the probation officer’s recommendation. If they recommend you for a pardon, it is HIGHLY LIKELY you will get it. In fact, I have never seen a person with a recommendation not get a pardon.
# 10 Your case gets placed on the docket for a pardon board hearing, they occur every three months.
# 11 - The hearing - if you are recommended, usually The Governor or someone makes a motion to GRANT all that were recommended, otherwise you and I go in and ARGUE for it.
# 12 - If you get your pardon, take a deep breath, reflect, and live happily ever after. If you are denied, we reapply in a year or two, and I will not charge you any more money for that. A VERY HIGH percentage of my applicants have been approved.
